Witnessing Wills
Governments everywhere are announcing proposals in response to economic challenges arising as a result of Covid-19, and this includes recent orders to allow for the witnessing wills remotely.
In Ontario, the Lieutenant Governor in Council made an order under s. 7.0.2(4), of the Emergency Management and Civil Protection Act allowing for the virtual witnessing for wills and powers of attorney provided that at least one person who is providing the service as a witness is a licensee pursuant to the Law Society Act.
In other words, as long as one witness is a lawyer. This Order is not retroactive and apparently will only be in place for the duration of the declaration of emergency.
The Order in Council is posted at: https://www.ontario.ca/search/orders-in-council and on e-Laws, as a regulation under the Emergency Management and Civil Protection Act at: https://www.ontario.ca/laws/statute/90e09?search=emergency+management.
